CREATOR5 TERMS OF SERVICE
Effective Date: August 13, 2026
Provider: Pepper, Elenore & Abbey, Inc. DBA FreelanceBigSis, CREATOR5 and CREATOR5 University, a Florida sole proprietor company ("CREATOR5," "we," "us," "our")
By proceeding with your purchase to join the CREATOR5 community or to enroll in CREATOR5 University, you expressly agree to the following terms and conditions:
1. Scope of Services.
CREATOR5 offers a unique membership geared toward the UGC community and all aspects of branding, marketing, and profiting. CREATOR5 provides its members with access to some or all of the following, depending on the specific offer purchased (collectively, the "Services"):
i. CREATOR5 Membership. Access to the private CREATOR5 member community; the CREATOR5 self-paced course library and creator roadmap covering user-generated content ("UGC"), personal brand and content creation, affiliate marketing, TikTok Shop, and the Amazon Influencer Program; member-only trainings, workshops, and replays; downloadable templates, workbooks, planners, and trackers; and eligibility to earn the CREATOR5 "Omni-Present Creator" designation upon completion of the applicable requirements.
ii. CREATOR5 University ("C5U"). A cohort-based mentorship program running for a defined term (currently four (4) months) that includes: placement into a level and a coached team based on your onboarding assessment; a curriculum that unlocks module by module as your coach approves your progress; group coaching sessions, office hours, and community voice sessions led by CREATOR5 coaches; onboarding pre-work; the Implementation Support Guarantee described in Section 5; CREATOR5 Membership at no additional charge for the duration of your cohort; and, upon successful graduation, the "Omni-Present Creator" credential (including a physical certificate, pin, and digital emblem), continued access to the C5U course materials, and access to the CREATOR5 Alumni Club.
iii. Offer Terms and Changes. The specific inclusions, schedule, price, and payment options for your purchase are those presented to you on the applicable checkout or sales page at the time of purchase, which are incorporated into these terms by reference. Coaches, trainers, guest experts, session times, curriculum sequencing, platforms, and community features may be added, substituted, or modified at CREATOR5's discretion, provided the overall scope and value of the Services are substantially maintained.
2. Eligibility.
i. You must be at least eighteen (18) years of age to purchase the Services.
ii. Your membership and enrollment are personal to you. Login credentials, community access, coaching access, and course materials may not be shared with, transferred to, resold to, or used by any other person, including business partners, family members, employees, or clients.
3. Payment and Billing.
i. Prices, payment options, and payment schedules are those displayed at checkout. If you select an installment or payment plan option, you authorize CREATOR5 (or its payment processor) to automatically charge your designated payment method for each scheduled installment until the full purchase price is paid.
ii. Selecting a payment plan does not reduce your obligation. You agree to pay the full purchase price regardless of your attendance, participation, completion, or continued use of the Services.
iii. You are responsible for keeping a valid payment method on file. If a payment fails or is not cured within [7] days of notice, CREATOR5 may suspend or terminate your access to the Services without waiving your obligation to pay the remaining balance, and may recover any costs of collection, including reasonable attorneys' fees.
iv. Where a third-party financing or installment provider (such as Afterpay) is used, your arrangement with that provider is governed by that provider's own terms, and CREATOR5 is not a party to it.
4. No Refunds or Exchanges.
i. The services provided are of a unique and original quality. All purchases are final. No refunds, returns, or chargebacks will be provided under any circumstances.
ii. This includes, without limitation, change of mind, failure to participate, failure to complete the program, dissatisfaction with results, or loss of access resulting from your violation of these terms.
iii. You agree not to initiate a chargeback or payment dispute. Initiating one constitutes a material breach of these terms and may result in immediate termination of access without refund, in addition to CREATOR5's other remedies.
5. Implementation Support Guarantee.
In place of a refund policy, CREATOR5 University members receive the Implementation Support Guarantee, which consists of the following:
i. Extended Support. If you have completed all assigned coursework, submitted all required deliverables, and attended the required sessions but your foundation deliverables are not complete by graduation, CREATOR5 will provide up to sixty (60) additional days of coaching support at no additional charge.
ii. Never-Stuck Support. When you submit a documented roadblock through the designated channel, a coach will provide direction within two (2) business days.
iii. Emergency Rollover. A one-time transfer of your enrollment to the next available cohort in the event of a qualifying life emergency, subject to CREATOR5's approval and documentation requirements.
iv. Nature of the Guarantee. The Implementation Support Guarantee is a support commitment only. It is not a refund, a money-back guarantee, or a guarantee of any income, result, outcome, or brand deal.
v. Eligibility. Eligibility requires that your account be current on all payments and in good standing.
6. Intellectual Property.
i. CREATOR5 is and shall be the sole and exclusive owner of all right, title, and interest throughout the world in and to all content, materials, and information provided as part of the Service, including but not limited to text, graphics, documents, and proprietary methods, which are exclusively owned by CREATOR5 and are protected by applicable intellectual property laws.
ii. This includes, without limitation, the CREATOR5 and CREATOR5 University names, logos, emblems, and marks; the "Omni-Present Creator" designation; and CREATOR5's proprietary frameworks, systems, and methodologies, including the CREATOR5 Income Stack System.
iii. No ownership rights in any of CREATOR5's intellectual property rights are transferred to you.
7. Limited License.
i. Grant. Any materials, content, or information provided to you as part of the Service are licensed to you on a limited, non-exclusive, non-transferable, revocable basis solely for your personal use within the scope of the Services.
ii. Materials. Such materials may include but are not limited to: recorded course modules, video lessons, masterclass and webinar replays, live coaching call recordings, slide decks and presentations, workbooks and fillable worksheets, roadmaps, checklists, scorecards and assessments, content calendars and planners, income and content trackers, Canva and design templates, email, pitch, and outreach scripts and templates, rate sheets and media-kit templates, contract and proposal samples, swipe files, resource lists, and written guidance shared inside the community ("Materials").
iii. Restrictions. You may not copy, reproduce, distribute, modify, share, or use such Materials for any purpose outside of the service without prior written consent from CREATOR5. You expressly agree not to use any Materials or information obtained through the Service for commercial purposes, competitive purposes, or in any way that is inconsistent with the intended purpose.
iv. Specific Prohibitions. Without limiting the foregoing, you may not use the Materials to create, teach, coach, sell, or market a competing course, membership, mentorship, workshop, or program; you may not record, screenshot, transcribe, or republish live sessions; and you may not upload Materials to any third-party site, file-sharing service, or artificial intelligence tool for redistribution or repurposing.
v. Permitted Use. Applying the strategies you learn to your own creator business, including client work you perform for brands, is expressly permitted and is the intended purpose of the Services. What is prohibited is redistributing or reselling the Materials themselves.
vi. Termination of License. This license terminates automatically upon termination of your access, except for any lifetime access rights expressly granted to graduates, which remain subject to these terms.
8. Community Conduct.
i. The CREATOR5 community is a shared space. You agree to conduct yourself professionally and respectfully at all times.
ii. You agree not to: harass, demean, or discriminate against other members, coaches, or staff; solicit, pitch, spam, or recruit members for other programs, offers, downlines, or services without prior written permission; share another member's personal information, income, business details, or contributions outside the community; share login credentials or community access; post unlawful, defamatory, or infringing content; or misrepresent your identity, results, or credentials.
iii. CREATOR5 reserves the right, in its sole discretion, to issue warnings, restrict participation, or remove any member from the community or program for conduct it determines to be disruptive or in violation of these terms, without refund.
9. Confidentiality.
i. Information shared by other members, coaches, and guest experts inside the community, coaching calls, and voice sessions, including personal circumstances, income figures, client names, rates, and business strategies, is shared in confidence.
ii. You agree not to disclose, publish, or repeat such information outside of the Services.
10. Your Content; Use of Your Name and Results.
i. Your Ownership. You retain ownership of the content, work product, and materials you create and submit within the Services. You grant CREATOR5 a non-exclusive, royalty-free, worldwide license to view, store, and use your submissions for the purpose of delivering coaching, feedback, and reviews within the Services.
ii. Testimonials and Likeness. If you provide a testimonial, review, or written or recorded success story, or if you consent in writing, you grant CREATOR5 the right to use your name, handle, likeness, statements, and results in its marketing and promotional materials.
iii. Withdrawal. You may withdraw consent for future marketing use by written request to [email protected]. Withdrawal does not require removal from materials already produced or distributed.
11. No Guarantee of Results.
i. Success depends on numerous factors outside the control of CREATOR5 thus past results or experiences are not indicative of future outcomes. CREATOR5 makes no guarantees regarding any specific results or success from the use of the Service.
ii. Any income figures, earnings, brand deals, follower counts, or results referenced by CREATOR5, its coaches, its guest experts, or its members, whether in marketing materials, webinars, testimonials, case studies, or inside the community, are illustrations of what is possible and are not typical, not average, and not promised. Your results will depend on factors including but not limited to your effort, consistency, skill, niche, audience, market conditions, and third-party platform policies.
iii. Nothing in the Services constitutes a representation, warranty, or guarantee that you will earn any particular amount of money, secure any brand partnership, be accepted into any platform or program, or recover the cost of your purchase.
12. No Professional Advice.
i. The Services are educational in nature. CREATOR5 is not a law firm, accounting firm, tax advisor, financial advisor, or talent agency, and nothing provided through the Services constitutes legal, tax, accounting, financial, or investment advice.
ii. You are solely responsible for your own business decisions, contracts, taxes, disclosures, and legal compliance, including compliance with all applicable advertising and endorsement disclosure requirements (such as the FTC Endorsement Guides).
iii. You are encouraged to consult your own licensed professionals.
13. Third-Party Platforms.
i. The Services reference and may require the use of third-party platforms, programs, and tools, including but not limited to TikTok and TikTok Shop, Amazon and the Amazon Influencer Program, Instagram, TikTok, Fiverr, affiliate networks, and payment and course-delivery providers.
ii. CREATOR5 is not affiliated with, endorsed by, or sponsored by these platforms, does not control them, and is not responsible for their policies, eligibility requirements, acceptance decisions, fees, algorithm changes, account suspensions, or discontinuation.
iii. Your use of any third-party platform is governed by that platform's own terms, and you are responsible for complying with them.
14. Access, Modification, and Termination.
i. CREATOR5 may modify, suspend, or discontinue any portion of the Services, including course platforms, community platforms, session schedules, coaches, and program features.
ii. Where "lifetime access" is offered, it means access for as long as CREATOR5 continues to offer the applicable program in substantially its current form. It does not create a perpetual obligation to maintain any particular platform, technology, or content library, and CREATOR5 will use reasonable efforts to provide notice and, where practical, access to download core Materials before any discontinuation.
iii. CREATOR5 may suspend or terminate your access immediately, without refund, for non-payment, chargeback initiation, breach of these terms, sharing of Materials or credentials, or conduct that harms the community.
15. Communications.
i. By purchasing, you consent to receive communications from CREATOR5 relating to your purchase and account, including onboarding, scheduling, program updates, and support messages, by email, SMS, and in-platform notification.
ii. You may opt out of marketing communications at any time using the unsubscribe mechanism provided. You may not opt out of transactional and program-delivery communications while your enrollment or membership is active.
iii. Message and data rates may apply.
16. Limitation of Liability.
i. CREATOR5 shall not be responsible for any consequential, special, incidental, or indirect losses or damages of any nature arising out of your use of the Services.
ii. The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
iii. To the maximum extent permitted by law, CREATOR5's total aggregate liability arising out of or relating to these terms or the Services shall not exceed the total amount you actually paid to CREATOR5 for the Services giving rise to the claim.
17. Indemnification.
i. You agree to indemnify, defend, and hold harmless CREATOR5 and its owners, officers, employees, coaches, contractors, and guest experts from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees).
ii. This applies to any such claim arising out of or related to your use of the Services, your content, your business activities, your dealings with brands, clients, or platforms, or your breach of these terms.
18. Venue and Governing Law.
i. These terms and conditions shall be governed by and construed in accordance with the laws of the State of Florida.
ii. Any disputes arising out of or relating to these terms and conditions or the Service shall be brought exclusively in the applicable state or federal courts located within Broward County, State of Florida, and you consent to the personal jurisdiction in such courts.
iii. The prevailing party in any such dispute shall be entitled to recover its reasonable attorneys' fees and costs.
19. Miscellaneous.
i. Entire Agreement. These terms, together with the offer details presented at checkout, constitute the entire agreement between you and CREATOR5 regarding the Services and supersede all prior communications, representations, and understandings.
ii. Severability and Waiver. If any provision is found unenforceable, the remaining provisions remain in full force and effect. CREATOR5's failure to enforce any provision is not a waiver of it.
iii. Assignment. You may not assign these terms. CREATOR5 may assign them in connection with a sale or transfer of its business.
iv. Updates. CREATOR5 may update these terms from time to time by posting the revised version, and continued use of the Services after the effective date constitutes acceptance of the revised terms.
v. Force Majeure. Neither party shall be liable for delays or failures in performance caused by circumstances beyond its reasonable control.
20. Acceptance of Terms.
i. By completing your purchase, you acknowledge that you have read, understood, and agree to be bound by the foregoing terms of service.
ii. If you are not agreeable to any of these terms as stated herein, please do not complete your purchase.
